Madinah Is a Sanctuary (haram)
[16] And with the same chain of narration that Abu Hurayrah said, “If I saw deer grazing at Madinah, I would leave them and not chase them away as the Messenger of Allah (Sallalahu Alayhi Was-Sallam) said, ‘What is between the two mountains (ie the area of Madinah) is Haraam (ie a Haram)’.”
[GRADING] – [SAHIH]
And this hadith has a support in Bukhari (no.1869) etc. and it is [Sahih] authentic with it Wal Hamdullilah
[REFERENCES] – [AGREED UPON]
Al-Muwatta (Yahya’s narration (6/889 hadith no.1711, book 45, chapter 3, hadith no.11) at-Tamhid (6/309) and al-Istidhkar (no.1641)
Transmitted by Bukhari (no.1873) and Muslim (471/1372) from the hadith of Malik.
[UNDERSTANDING FROM THE HADITH]
1) Just like Makkah Mukaramah, Madinah Tayibah is also a forbidden sanctuary (haram) as it is established from the Mutawatir hadith. See Nazm al-Mutanathir Minal Hadith al-Mutawatir of Kittani (pg.212) hadith (no.244), other than Abu Hurayrah (RadhiAllaahu Anhu) the following companions (RadhiAllaahu Anhum) also narrated this:
Anas Ibn Malik (RadhiAllaahu Anhu) (Sahih Bukhari: (no.1867), and Sahih Muslim: (no.1366)
Ali (RadhiAllaahu Anhu) (Sahih Bukhari: (no.1870), and Sahih Muslim: (no.1370)
Abdullah Ibn Zayd Ibn Asim (RadhiAllaahu Anhu) (Sahih Bukhari: (no.2129), and Sahih Muslim: (no.1360)
Rafi Ibn Khadij (RadhiAllaahu Anhu) (Sahih Muslim: (no.1361)
Jabir Ibn Abdullah Ansari (RadhiAllaahu Anhu) (Sahih Muslim: (no.1362)
Sad Ibn Abi Waqas (RadhiAllaahu Anhu) (Sahih Muslim: (no.1363) and other than them
In opposition to these authentic mutawatir Hadith, some people say, based on their self fabricated doubts that: “Madinah is not a sanctuary according to us.” (Rad al-Mukhtar ‘Ala Dur ul-Mukhtar (2/278), ad-Dur al-Mukhtar (1/184) [Trans Note: this is a reprimand of the hanafi position as mentioned by the 2 aforementioned books which clearly contradicts the authentic Sunnah]
2) It is prohibited (haram) to hunt, cut trees and plants in Madinah except for lemongrass which has been permitted [Trans Note: The permissions is based on lemongrass being an asset]
3) Abu Hurayrah (RadhiAllaahu Anhu) was always ready to act on the hadith of the noble Prophet (Sallalahu Alayhi Was-Sallam).
4) The hadith is also evidence (and an authority) just like the Qur’an, the hadith is an unapparent revelation.
