The Permissibility of Eating Horse Meat
[370] Narrated Asma bint Abu Bakr (Radiullahu Anhuma)
We slaughtered a horse during the lifetime of the Prophet (Sallalahu Alayhi Wa Sallam) and ate it. And in another narration she said, “and we were in Madina”

[RULINGS FROM THE HADITH]
1) This hadith proves that the meat of horses is halal and thus permissible to eat
2) The hadith of Jabir (RadhiAllahu Anhu) is a Qawli hadith in which the Messenger of Allah (Sallalahu Alayhi Wasallam) gave permission for horse meat to be consumed and in the wording of Bukhari it mentions the word Rakhasa i.e. if need be instead of explicit permission. 3) Imams Ahmad, Shafi, Abu Yusuf, Muhammad Shaybani held it is permissible and lawful to eat where as Imams Abu Hanifah and Malik were of the position it is unlawful i.e. haram to eat. [Subl al-Salam [4:1824]
4) This incident took place in Madinah after Jihad was textually obligated as other narrations elucidate Asma (RadhiAllahu Anha) said we were in Madinah.
5) Animals that one can make Dhahb one can also make Nahr of them and vice versa and it is recommended to make Nahr of Camels only and dhahb of other animals.
